At a 12 August press conference in Amman, the Patriarch of the Holy City of Jerusalem, All Palestine and Jordan Theophilos III said that a decision delivered on the 7 August by Israel’s Jerusalem District Court regarding two hotels near the Jaffa Gate in Jerusalem’s Old City has “crossed the lines of justice and reasonableness.”

The decision relates to a claimed real estate deal concluded in 2004, without due authority and consent, by the then finance department assistant to the deposed Patriarch Irineos, Nikolas Papadeemas and the Israeli organization Ateret Cohanim. The latter started proceedings in 2007 requesting the court to uphold the deal while the Patriarchate of Jerusalem denied their validity and fought to revoke them.

“We have stood silent, bearing patient witness to a harsh campaign against us and against our Patriarchate, that seemed to grow in strength daily with false accusations and slander, targeting our heritage and our integrity,” stated Theophilos III. “Today, it is our call of duty and our commitment, entrusted to us by the Lord, that leads us to break our silence and say: Enough is Enough.”

The court ruled there was no evidence of fraud or bribery while the church asserts that the claimed deal, was conducted without due authority, in bad faith, using conspiracy and bribery.

“We are constrained to take this unprecedented action in calling this press conference to reject publicly and clearly the unfair ruling of the Israeli District Court in the Jaffa Gate case,” said Theophilos III. The Patriarchate will initiate an appeal process, however, “This decade-long legal battle has resulted in an unjust decision which disregarded all of the Patriarchate’s clear and concrete legal evidence proving bad faith, bribery and conspiracy,” he said.

The biased decision affects not only the Patriarchate but also strikes at the heart of the Christian Quarter of the Old City, he continued. “It could well lead to escalated tension in our community that we are all working diligently to try and diffuse.”

More crucially, Theophilos III is raising the red flag on behalf of churches in the Holy Land as he believes the situation to be far more critical for all the churches, drawing on a recent proposed law, introduced by 40 members of the Knesset, that would severely restrict the rights of churches to deal freely and independently with their lands and would threaten their confiscation.

“This bill is a clear attempt to deprive our 2,000-year-old Patriarchate, as well as our fellow churches, present for centuries in the Holy Land, of our legitimate and historic freedom and independence,” Theophilos III concluded. “This intolerable bill, if passed, would be a clear violation of every international treaty that has governed the region, and would be an insupportable assault on the freedom of worship.”

Theophilos III called for an urgent meeting of the Heads of Churches of the Holy Land to coordinate opposition and response to these developments. “We cannot stress too highly the extreme seriousness of this situation,” he said.

In July 2017, we, the heads of the Churches in Jerusalem, were compelled to issue a public statement of concern regarding breaches of the Status Quo that governs the Holy Sites and ensures the rights and privileges of the Churches. This Status Quo is universally recognised by both religious authorities and governments, and has always been upheld by the civil authorities of our region.

We now find ourselves united once again in condemning recent further encroachment on the Status Quo. In such matters as this, the Heads of the Churches are resolute and united in our opposition to any action by any authority or group that undermines those laws, agreements, and regulations that have ordered our life for centuries.

There have been further actions that are a clear breach of the Status Quo. The judgement in the “Jaffa Gate” case against the Greek Orthodox Patriarchate of Jerusalem, which we regard as unjust, as well as a proposed bill in the Knesset which is politically motivated that would restrict the rights of the Churches over our own property, are further assaults on the rights that the Status Quo has always guaranteed.

We see in these actions a systematic attempt to undermine the integrity of the Holy City of Jerusalem and the Holy Land, and to weaken the Christian presence. We affirm in the clearest possible terms that a vital, vibrant Christian community is an essential element in the make-up of our diverse society, and threats to the Christian community can only increase the troubling tensions that have emerged in these turbulent times.

Such attempts to undermine the Christian community of Jerusalem and the Holy Land do not affect one Church only; they affect us all, and they affect Christians and all people of good will around the world. We have always been faithful to our mission to ensure that Jerusalem and the Holy Sites are open to all, without distinction or discrimination, and we are unanimous in our support of the actions, including a High Court appeal, against the judgement in the “Jaffa Gate” case and in our opposition to any proposed law that would restrict the rights of the Churches over our properties.

We therefore, as those to whom Divine Providence has entrusted the care of both the Holy Sites and the pastoral oversight of the living, indigenous Christian communities of the Holy Land, call upon our fellow Church leaders and faithful around the world, as well as the heads of governments, and all people of good will, to support us in order to ensure that no further attempts are made from any quarter to change the historical Status Quo and its provisions and spirit.

We cannot stress strongly enough the very serious situation that this recent systematic assault on the Status Quo has had on the integrity of Jerusalem and on the well-being of the Christian communities of the Holy Land, as well as on the stability of our society.

We, the Heads of the Churches in Jerusalem, stand resolutely together in working for reconciliation and for a just and lasting peace in our region, and we ask God’s blessings on all the peoples of our beloved Holy Land.

Assault on the “Status Quo” in order to weaken the Christian presence in the Holy Land

Jerusalem – According to the Patriarchs and Heads of the Churches of Jerusalem, “a systematic attempt to undermine the integrity of the Holy City” and “to weaken the Christian presence in the Holy City” is in progress. This project clearly manifests itself in the “recent violations of the Status Quo” of the Holy Sites, and also a bill signed by about forty members of the Israeli Parliament, “limiting the rights of the Churches on our properties”. The Heads of the Churches are resolute and united in their opposition to “any action” by “any authority or group” that undermines those “laws, agreements, and regulations that have ordered our life for centuries”.

The document, published yesterday by the official channels of the Churches, is signed by thirteen heads of Churches and Christian communities present in Jerusalem. The list of signatories is opened by Teophilos III, Greek Orthodox Patriarch of Jerusalem, and also includes Archbishop Pierbattista Pizzaballa, apostolic Administrator of the Latin Patriarchate of Jerusalem, and Father Francesco Patton OFM, Custos of the Holy Land.

What triggered the Christian Churches’ concerns regarding the Status quo that regulates coexistence between religious communities in the Old City of Jerusalem was the ruling with which the Israeli Court, at the beginning of August, after a long controversy, rejected the legal initiatives with which the Greek Orthodox Patriarch of Jerusalem had attempted to recognize the acquisition of some of its properties by the Jewish organization Ateret Cohanim, which took place in 2004, as “illegal” and “unauthorized”. There have been further actions that are a clear breach of the Status Quo. The judgement in the “Jaffa Gate” case against the Greek Orthodox Patriarchate of Jerusalem, which heads of Churches regard as unjust, as well as a proposed bill in the Knesset which is politically motivated.

The reported attempts – states the document – do not concern a single Church, but strike all of us and strike Christians and all people of good will all over the world. We have always been faithful – write the Christian leaders – to our mission to ensure that Jerusalem and the Holy Sites are open to all, without distinction or discrimination. The signatories also agree to support the Greek Orthodox Patriarchate’s appeal to the Supreme Court of Israel against the ruling held in August. They appeal to Christian leaders and the faithful from all over the world, and also to government leaders, so that they can find widespread and international support for all initiatives aimed at ensuring respect for the rules of the Status Squo in the Holy Sites as a concrete contribution to the establishment of a “just and lasting peace” throughout the region.

In a statement released the first week of September, the patriarchs and local heads of churches in Jerusalem condemned further encroachments on the status quo related to the city’s holy sites. The text is the second statement of concern in three months about the status quo, with a prior one issued in July.

“This Status Quo is universally recognized by both religious authorities and governments, and has always been upheld by the civil authorities of our region,” reads the statement. “We now find ourselves united once again in condemning recent further encroachment on the Status Quo.”

The heads of the churches said they are united in their opposition to any action by any authority or group that undermines the laws, agreements, and regulations that have ordered their lives for centuries.

“There have been further actions that are a clear breach of the Status Quo,” reads the statement. “The judgement in the ‘Jaffa Gate’ case against the Greek Orthodox Patriarchate of Jerusalem, which we regard as unjust, as well as a proposed bill in the Knesset which is politically motivated that would restrict the rights of the Churches over our own property, are further assaults on the rights that the Status Quo has always guaranteed.”

Dear Mr. President,

We are fully aware and appreciative of how you are dedicating special attention to the status of Jerusalem in these days. We are following with attentiveness and we see that it is our duty to address this letter to Your Excellency. On July 17, 2000, we addressed a similar letter to the leaders who met in Camp David to decide the status of Jerusalem. They kindly took our letter into consideration. Today, Mr. President, we are confident that you too will take our viewpoint into consideration on the very important status of Jerusalem.

Our land is called to be a land of peace. Jerusalem, the city of God, is a city of peace for us and for the world. Unfortunately, though, our holy land with Jerusalem the Holy city, is today a land of conflict.

Those who love Jerusalem have every will to work and make it a land and a city of peace, life and dignity for all its inhabitants. The prayers of all believers in it—the three religions and two peoples who belong to this city—rise to God and ask for peace, as the Psalmist says: “Return to us, God Almighty! Look down from heaven and see!” (80.14). Inspire our leaders, and fill their minds and hearts with justice and peace.

Mr. President, we have been following, with concern, the reports about the possibility of changing how the United States understands and deals with the status of Jerusalem. We are certain that such steps will yield increased hatred, conflict, violence and suffering in Jerusalem and the Holy Land, moving us farther from the goal of unity and deeper toward destructive division. We ask from you Mr. President to help us all walk towards more love and a definitive peace, which cannot be reached without Jerusalem being for all.

Our solemn advice and plea is for the United States to continue recognizing the present international status of Jerusalem. Any sudden changes would cause irreparable harm. We are confident that, with strong support from our friends, Israelis and Palestinians can work towards negotiating a sustainable and just peace, benefiting all who long for the Holy City of Jerusalem to fulfil its destiny. The Holy City can be shared and fully enjoyed once a political process helps liberate the hearts of all people, that live within it, from the conditions of conflict and destructiveness that they are experiencing.

Christmas is upon us soon. It is a feast of peace. The Angels have sung in our sky: Glory to God in the highest, and peace on earth to the people of good will. In this coming Christmas, we plea for Jerusalem not to be deprived from peace, we ask you Mr. President to help us listen to the song of the angels. As the Christian leaders of Jerusalem, we invite you to walk with us in hope as we build a just, inclusive peace for all the peoples of this unique and Holy City.

But the angel said to them [the shepherds], ‘Do not be afraid; for see- I am bringing you good news of great joy for all the people: to you is born…a saviour, who is the Messiah, the Lord.’” (Luke 2.10)

At this moment the world’s gaze is fixed on Jerusalem, a city that is holy to all Abrahamic faiths. We, the Patriarchs and Heads of Churches in Jerusalem, as we approach the celebration of Christmas, reaffirm our clear position in calling for the preservation of the Status Quo of the Holy city until a just peace agreement has been reached between the Israelis and Palestinians on the bases of negotiations and International law.

The Christians of the Holy Land, know that their presence and witness is strictly related to the holy sites and their accessibility as places of meeting and encounter for unity between peoples of different faiths. It is the holy places that have given the region meaning.
Any exclusive political approach to Jerusalem will deprive the city of its real essence and characteristics and tramples on the mechanism that has maintained peace throughout the ages. Jerusalem, is a sacred gift; a tabernacle; hallowed ground to the entire world. Attempting to possess the Holy City Jerusalem, or confine it with terms of exclusivity will lead to a very dark reality.

At this time, as we await the coming of the Light, we bring you great tidings of joy, hope and peace from the City of hope and peace, Jerusalem! Year after year we join the Church universal in celebrating the birth of our Lord and Saviour Jesus Christ. The incarnation of the Word made flesh continues, after two millennia, to be a source of joy, hope and peace, despite the suffering and affliction of many nations and communities around the globe.

The angelic proclamation to the shepherds in Bethlehem brought good news, great joy, and a promise of peace to all people, especially those who are suffering and live in fear and anxiety of what the future holds for them and their loved ones. The angel appeared to the shepherds who were watching their flock at night, and the glory of the Lord came to dispel the darkness of their night and to announce the new day that had dawned with the birth of Christ. At that moment the shepherds were afraid and could not comprehend the meaning of the angelic proclamation, and how the birth would impact their lives and the life of their community.

These people of Bethlehem who suffered under the Roman occupation and their compatriot Herod, and subject to distinctions and exclusions of the socio-political economy, were confronted with a different economy: God’s providence. The message of the angels revealed to the shepherds – out of their own context – a new reality, where the concepts of power and authority are transformed by the incarnation of God in a lowly manger.

The shepherds responded immediately to this theophany and went to see the “thing that has taken place which the Lord has made known to [them]”. The world today is confronted once more with the challenge of responding to the angelic proclamation which demands participation in the Divine economy in bringing forth joy, hope and peace to a world torn apart by violence, injustice and greed.

We continue to hold the whole Region of the Middle East in our prayers, and ask the Prince of Peace to inspire the hearts and minds of all those in authority to walk in the path of peace, justice and reconciliation among the nations. As we celebrate the coming of Christ as the light of the world, we are inspired by and take comfort in the words of the hymn of Zechariah – “the dawn from on high will break upon us, to give light to those who sit in darkness and in the shadow of death, to guide our feet into the way of peace”.

The Patriarchs and Heads of Local Churches issued the following statement yesterday following the decision of the Municipality of Jerusalem to impose municipal taxes on church properties.

Following the statement by the Municipality of Jerusalem declaring that the Churches in Jerusalem should pay municipal taxes (known as Arnona), we, the Heads of Churches in Jerusalem, declare that such a statement is contrary to the historic position between the Churches within the Holy City of Jerusalem and the civil authorities across the centuries. The civil authorities have always recognized and respected the great contribution of the Christian Churches, which invest billions in building schools, hospitals, and homes, many for the elderly and disadvantaged, in the Holy Land.

We declare that such a measure both undermines the sacred character of Jerusalem, and jeopardises the Church’s ability to conduct its ministry in this land on behalf of its communities and the world-wide church.

We request the Municipality to retract their statement and ensure that the status quo which was sanctioned by the sacred history is maintained, and the character of the Holy City of Jerusalem is not violated.

We stand firm and united in our position to defend our presence and properties.

“Blessed be the God and Father of our Lord Jesus Christ! By his great mercy he has given us a new birth into a living hope through the resurrection of Jesus Christ from the dead.” (1 Peter 1.3)

We, the Patriarchs and Heads of Churches in Jerusalem, jointly send our Easter greetings and joyful proclamation of the Resurrection of our Lord and Saviour to all people everywhere. From Jerusalem, the place where Christ was raised from the dead, we offer our blessings to the faithful who are celebrating the Feast of the Resurrection at this blessed time.

For over two millennia pilgrims have been following the footsteps of Jesus and streaming to Jerusalem to behold the empty tomb. The Resurrection of our Lord was an historic event which encompassed the whole cosmic order and renewed the face of the entire creation. This is the time where the Christian Family worldwide remembers God’s redeeming work in the life, death, and resurrection of Jesus Christ. Jerusalem, the City of Hope and the Resurrection, remains a sacred symbol of God’s salvation and a reflection of the heavenly Jerusalem that is yet to come. In fact this sacred, communal, and spiritual character of Jerusalem continues to be a beacon for hope, peace, and life for the people of this region and the entire world. We pray that we here in the Holy Land may continue unhindered to fulfil our sacred duty as manifestations of the living Gospel to serve the poor, seek justice and walk in the light and love of the risen Christ.

The Holy Gospel tells us that before Jesus Christ ascended to joy he suffered pain, and before entering into glory he was crucified. We pray to almighty God that people who are walking in the way of the cross may find it the way of hope, peace, and life. We hold in our prayers all those who are suffering in our region and throughout the world, and also, all those who are suffering in silence; for refugees, asylum seekers, and displaced people, for those who live under oppression, for those in want and deprivation, for all victims of violence and discrimination, and for all who strive for justice and reconciliation.

The Resurrection of our Lord Jesus Christ from the dead is a constant reminder that the powers of evil and death will not overcome life, instead life has victory over death and darkness. God has reconciled us to Himself in Jesus Christ and called us to the ministry of reconciliation. May the risen Lord strengthen us with His Holy Spirit in order to go forth in his risen life to love and serve and bring the good news to all.

Christ is risen. Alleluia! He is risen, indeed. Alleluia!
